REGLAS PARA EL FUNCIONAMIENTO COMITÉ INTERMINISTERIAL SOBRE CIBERSEGURIDAD

RULES FOR THE OPERATION OF THE INTERMINISTERIAL COMMITTEE ON CYBERSECURITY

Article 1º.- About the committee’s functions. The “interministerial comittee on cybersecurity” from no won, “the committee” shall have the functions and powers included in the second article of the decree that creates the Committee, consisting of:

  1.  
    1. 1- Advise the President of the Republic, in the analysis and definition of the national cybersecurity policy, which will contain the measures, plans and specific action programs that will be applied for its execution and compliance.
    1. 2- Identify current and potential threats in the field of cyberspace, proposing actions to overcome the gaps that are identified and monitor their compliance.
    1. 3- Analyze and propose the alternatives of organic structure for cybersecurity in Chile.
    1. 4- Analyze and study the current legislation applicable to cyberspace, proposing the constitutional, legal and regulatory modifications that are necessary.
    1. 5- Seek coordination between public and private actors linked to cybersecurity.

Article 2º.- Composition of the Committee.
The Committee will be composed of the following permanent members:

  • A representative of the Undersecretary of the Interior.
  • A representative of the Undersecretary of Defense.
  • A representative of the Undersecretary of Foreign Relations.
  • A representative of the Undersecretary of Justice.
  • A representative of the Assistant Secretary General of the Presidency.
  • A representative of the Undersecretariat of Telecommunications.
  • A representative of the Undersecretariat of Economy.
  • A representative of the National Directorate of the National Intelligence Agency.

Article 3º.- Presidency and Executive Secretary of the Committee. The Committee will be chaired by whoever is a representative of the Undersecretariat of the Interior, and will correspond, among other functions:

  1. Call the sessions of the Committee.
  2. Conduct the Committee sessions.
  3. Submit to the decision of the Committee the proposals that are necessary to give
  4. fulfillment of its mission.
  5. Provide technical and administrative support for the proper internal functioning of the Committee.

The Executive Secretary of the Committee will be a professional designated by the Undersecretariat of Defense for this purpose, and will correspond, among other functions:

  1. Record minutes of the Committee sessions.
  2. Propose the Committee’s agenda.
  3. Monitor compliance with the agreements adopted within the Committee.
  4. Provide technical and administrative support for the proper internal functioning of the Committee.

The Committee may agree to entrust representatives of other institutions with the development of specific tasks within the framework of its purpose.

Article 4º.- Appointment of representatives and call to sessions.
The authorities indicated in the second article must appoint a regular representative and one or more alternate representatives, addressed to the Chair of the Committee. The latter will act in the absence of the owner with the same rights. Along with communicating the appointment of the titular and alternate representative, each body must indicate at least one email as the point of contact for communications with the Chair and the Executive Secretary of the Committee.

Additionally, the authorities must appoint at least one representative from the information technology area of ​​their respective institutions in order for them to join the subcommittees that require it.

Article 5º.- Committee sessions.
The Committee will meet monthly or by summons made at least two business days in advance.

The call will be made by the Presidency or the Executive Secretary at the request of the latter, and will contain a table of matters to be discussed, and may include support materials for the development of the session. To start the session, the presence of the Presidency and the Executive Secretariat will suffice.

Article 6º.- Adoption of agreements.Minutes of the sessions will be drawn up in which the resolutions, actions or agreements adopted by the Commission will be recorded. Resolutions, actions or agreements will be adopted by consensus or a simple majority of the permanent members who are present at the respective session. In the latter case, the minority votes must be recorded in the minutes. The vote of the Presidency will decide in the event of a tie.

Article 7º.- Formation of subcommittees.

The Committee may appoint subcommittees for the knowledge of certain matters.

Article 8º.- Invited members.
In order to know the opinion or request the delivery of information regarding any point related to the functions of the Committee, the latter may invite officials of the State Administration or other public authorities to participate in its sessions, as well as representatives of entities international, public or private, academic and groups of civil society or the private sector. The call for invited members to the Committee will be made by official letter from the Undersecretariat of the Interior.

Non-permanent members will not have the right to vote.

Article 9º.- Conducting studies.
The Committee, when it deems it appropriate, may request specific studies to be carried out to better fulfill its functions.
